For Piscinas Bramex S. de R.L. de C.V. and its subsidiaries(hereinafter Glüp Piscinas) the information of our customers represents one of the most important elements in our operation, so at all times we handle it confidentially and protect it through various processes and administrative, physical and technological elements. In compliance with the Federal Law for the Protection of Personal Data in Possession of Individuals, published in the Official Gazette of the Federation on July 5, 2010 (the Law), as well as its respective Regulations, Glüp Piscinas makes this Privacy Notice available to all its Customers.
DEFINITION OF PERSONAL DATA
For the purposes of this Privacy Notice, Personal Data shall be understood as all information concerning the person of the Contracting Party, Insured Party, Beneficiary, Beneficiary or Joint and Several Obligor, including but not limited to name, address, telephone number, federal taxpayer registry, e-mail address, (hereinafter Personal Data).
PERSON RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA
Glüp Piscinas hereby states that the Personal Data of its Customers shall be handled with absolute confidentiality and that the collection, use, disclosure and storage thereof (hereinafter referred to as "Processing") shall only be carried out for the purposes detailed below. Likewise, it is made known to our customers that the person responsible for the processing of personal data collected in connection with the procurement of services for the manufacture, sale and distribution of fiberglass pools, will be the General Manager, which indicates as its address for purposes relating to this Privacy Notice the registered.
PURPOSES OF THE PROCESSING OF PERSONAL DATA
Glüp Piscinas will only process Personal Data for the following purposes:
A) Relating to the relationship between Glüp Piscinas and its Customers:
1. For the intermediation in the conclusion of contracts for the purchase of fiberglass swimming pools.
2. To duly comply with the obligations arising from the relationship between the Client and Glüp Piscinas.
3. To duly comply with the obligations arising from the relationship between the Client and service providers, represented by Glüp Piscinas, and any other company related to such activity, such as, but not limited to, Sellers, Builders, Drivers, Transporters, etc.
4. To comply with the applicable legislation.
5. For the support in the accomplishment of fiscal procedures.
6. To offer the Client advice on the products they have purchased, whether through the intermediation of Glüp Piscinas or by any other means.
7. To provide attention and follow-up to the Customer's requests and to the services provided by Glüp Piscinas to the latter, including assistance.
8. For statistical, financial, administrative or quality purposes.
B) Complementary purposes to the relationship between Glüp Piscinas and its Customers:
1. For training of representatives and business associates.
2. To offer you new options regarding the services and products that Glüp Piscinas or its affiliated companies offer or will offer in the future.
HOW TO CONTACT GLÜP PISCINAS
The General Manager of the company will be responsible for the area of ATTENTION FOR THE PROTECTION OF PERSONAL DATA, which for this purpose has Glüp Piscinas, and he will be responsible for ensuring with its direct and indirect employees and representatives, that all requests that their customers may have are made in terms of the aforementioned law, as well as to monitor the proper treatment of their personal data, in terms of this Privacy Notice.
In the event that any of our Clients wish to limit the use or disclosure of their Personal Data, wish to exercise their right of access, rectification, cancellation or opposition, or seek to clarify or update their Personal Data or revoke their consent, they should contact the PERSONAL DATA PROTECTION ATTENTION area in writing through the e-mail address registered for such purpose in the information provided to Glüp Piscinas.
In order to do so, the Client must send an e-mail to the following address: contacto@glupiscinas.com requesting the corresponding modifications.
It is important for our Clients to bear in mind that, in terms of the applicable Law, in order for Glüp Piscinas to process any request made by any of our Clients in terms of this Privacy Notice, the holder of the Personal Data must comply with the requirements set forth in the same Law and its Regulations.
TRANSFER OF PERSONAL DATA TO THIRD PARTIES
Likewise, by means of this Privacy Notice, Glüp Piscinas informs its Clients that eventually, exclusively for the purpose of complying with the purposes mentioned in this document, it may transfer the Personal Data of its Clients to third parties, such as, but not limited to, Vendors, Builders, Drivers, Carriers, service providers or related companies with which it has a legal or commercial relationship; transfer that will be carried out with due security measures, in accordance with the principles contained in the Law and exclusively to the areas designated for this purpose by each of said parties.
SECURITY MEASURES
Concerned about the proper treatment and care of the personal data of our customers, Glüp Piscinas maintains various mechanisms, procedures and security measures, both administrative, technological and physical, aimed at achieving the protection of such information against damage, loss, alteration, destruction or unauthorized use. It is worth mentioning that as part of said mechanisms and security measures, Glüp Piscinas has entered into confidentiality agreements with all the companies with which it works or has a legal relationship, which commit it to carry out an adequate treatment of the Personal Data and to respect the terms contained in this Privacy Notice.
Glüp Piscinas will at all times refrain from selling or leasing in any way the Personal Data of its Clients to any third party without the authorization or full knowledge of the Client.
STORAGE OF PERSONAL DATA
By virtue of this Privacy Notice, from the moment the Customer grants its consent, in accordance with the Consent section of this document, Glüp Piscinas may keep in its records, both physical and electronic, all the information provided by the Customer through any of the means made available to it by Glüp Piscinas in order to collect its Personal Data.
MODIFICATIONS TO THE PRIVACY NOTICE
Glüp Piscinas reserves the right to modify this Privacy Notice at any time, and therefore informs its Clients that any change or modification to its contents will be communicated to them in a timely manner by e-mail to the e-mail address registered for this purpose or by any other printed or electronic means that Glüp Piscinas deems appropriate for this purpose.
CUSTOMER CONSENT
The Client hereby declares that he/she knows and fully understands the content, purposes and scope of the Privacy Notice that Glüp Piscinas has for the relationship with its Clients, which has been transcribed in this document, and therefore grants his/her full express consent for Glüp Piscinas to carry out the Processing, including, if applicable, the disclosure of his/her Personal Data under the terms of said Privacy Notice.
Likewise, the Client agrees that the payment of the services that it enters into or has entered into with Glüp Piscinas or any request for a quotation, and in general any request for services by Glüp Piscinas in verbal or written form shall be taken as an unequivocal sign of the express consent that it has given for Glüp Piscinas to carry out the Processing of its Personal Data in terms of the Privacy Notice mentioned in the immediately preceding paragraph.
